Are you aware of a wrongdoing?
If you are an employee of a public entity and you believe that you have information that could show that a wrongdoing has been committed or is about to be committed, you may make a disclosure to a supervisor, the designated officer of the public entity, if one exists, or the Public Interest Disclosure Commissioner (PIDC).
What is a wrongdoing?
If you are an employee of a public entity you may disclose a wrongdoing and be protected from reprisal under the PIDWA provided the wrongdoing is disclosed in good faith.
A “wrongdoing” is defined in the PIDWA under section 3 as:
(a) a contravention of an Act, a regulation made under an Act, an Act of Parliament, or a regulation made under an Act of Parliament;
(b) an act or omission that creates a substantial and specific danger
(i) to the life, health or safety of individuals, other than a danger that is inherent in the performance of the duties or functions of an employee, or
(ii) to the environment;
(c) gross mismanagement of public funds or a public asset;
(d) knowingly directing or counselling an individual to commit a wrongdoing described in any of paragraphs (a) to (c).
Can I disclose a wrongdoing?
Please Note
An employee may make a disclosure even if a provision in another Act prohibits or restricts disclosure of the information.
There are rules in the PIDWA about who can disclose, what may be disclosed and to whom. Failure to follow these rules may result in no reprisal protection. Therefore, it is recommended you seek advice prior to making a disclosure.
While efforts are made to ensure your identity is confidential, it is not always possible to protect your identity.
How do I disclose a wrongdoing?
A disclosure must be in writing and to fulfill that requirement, the office of the PIDC has developed the Disclosure of Wrongdoing Form. Please contact our office to get a copy of this form, then submit it using secure file transfer or deliver in person to the PIDC. Do not email the form as this is not a secure method of communication. If you have any questions while completing the form, you may seek advice or contact our office for more information.

What happens to an employee who commits a wrongdoing?
An employee who commits a wrongdoing is subject to appropriate disciplinary action, including termination of employment.
What happens to an employee who discloses a wrongdoing?
An employee who seeks advice about making a disclosure, made a disclosure, co-operated in an investigation, or declined to participate in a wrongdoing must not be reprised against or be directed that reprisal be taken against you.
